One more problem has been settled by the Centre

The inhabitants of Fonichala appealed to the Ecological Law Centre, as they were much disturbed by the functioning of a quarrying enterprise of LTD “Arkitrav” just recently set to motion next to them. The enterprise causes unbearable noise and dust, that exposes the local population’s health to danger. Also, because of the raised dust the normal functioning of the population employed in agriculture becomes impossible.










A corresponding letter with the request to settle the problem urgently was sent by the Centre to the environmental protection.
The inspection of environmental protection took drastic measures, on the basis of the message sent by the Ecological Law Centre, for the damage caused to environment the record of an administrative infringement was drawn up and LTD “Arkitavr” was incurred an administrative penalty. Also, as the population explained, the noise caused by the actual problem has been settled.

ეკოლოგიური სამართლის ცენტრს" აგვისტოში  ფონიჭალის მაცხოვრებლებმა მიმართეს, რომლებიც შეწუხებულნი იყვნენ მათ გვერდით ახლახანს ამოქმედებული შპს ,,არქიტრავი’’-ს ქვის სატეხი საწარმოს მუშაობით. საწარმო  აუტანელ ხმაურს და მტვერს იწვევს, რითაც საფრთხე ემუქრება ადგილობრივი მოსახლეობის ჯანმრთელობას. ამასთან, გამოყოფილი მტვერის შედეგად შეუძლებელი ხდება სოფლის მეურნეობაში დასაქმებული მოსახლეობის ნორმალური ფუნქციონირება.

გარემოს დაცვის ინსპექციამ გადამჭრელი ზომები მიიღო,  „ეკოლოგიური სამართლის ცენტრის“ მიერ გაგზავნილი შეტყობინების საფუძველზე, გარემოსზე მიყენებული ზიანისთვის შპს ,,არქიტრავს’’ შეუდგინეს ადმინისტრაციული სამართალდარღვევის ოქმი და დააკისრეს ადმინისტრაციული სახდელი. ამასთან, მოსახლეობის განმარტებით, საწარმოს მუშაობის შედეგად გამოწვეული  ხმაური ჩაიხშო და არსებული პრობლემა მოგვარდა.

Ecological Law Centre is planning to send over the materials against the Ministry of Environmental Protection to procurator’s office

On October 5 the representatives of Ecological Law Centre have arranged a press conference, where they presented evidences proving the guilt of the Ministry if Environmental Protection in the forest fires of the year 2010.
On September 8 of 2010, the chairman of the Forestry agency Papuna Khachize held a special briefing, where he acquainted the journalists and the public with the statistics of the forest fires occurred in summer of 2010.










In Georgia totally up to 430 hectares of forest tracts have been destroyed. In Bakuriani-Borjomi forest section 20 hectares, in Atskuri forest section 300 h; in the borough of Surami 10h; in Racha and Mtskheta-Tianeti region 20-20 h; and in Kvareli forest section 50 h. of forest tracts were destroyed.
The Ministry of Environmental Protection has greatly contributed to destroying 430 h. of forest tracts, as in 2010 anti-fire preventive measures hadn’t been passed by them.
The chairman of forestry agency Papuna Khachidze in the letter sent to us has confirmed and actually admitted, that precisely his department is guilty of forest fires. The law obliged the Ministry of Environmental Protection to conduct anti-fire preventive measures and non-fulfillment of this obligation leads to violation of:
1. The B-sub point of the second paragraph of forestry department regulations of the Ministry of Environmental Protection and Natural resources in Georgia.
2. The E-sub point of the sixth paragraph about forestry agency – the juridical person of public law by Georgia legislation.
3. The 55th paragraph of Georgia’s law about the State budget of 2010
4. D – sub point of the 10th paragraph of Georgia’s forestry code.
If in 2011 the same be repeated in the forests of Georgia the Ecological Law Centre will be obliged to appeal this time to the main procurator’s office.

ეკოლოგიური სამართლის ცენტრი” გარემოს დაცვის სამინისტროს წინააღმდეგ მასალების პროკურატურაში გადაგზავნას გეგმავს

5 ოქტომბერს ”ეკოლოგიური სამართლის ცენტრის” წარმომადგენლება პრესკონფერენცია გამართეს, რომელზეც წარმოადგინეს 2010 წელს ტყეებში გაჩენილ ხანძრების გამო გარემოს დაცვის სამინისტროს ბრალეულობის დამადასტურებელი მტკიცებულებები.










2010 წლის 8 სექტემბერს, სატყეო სააგენტოს თავმჯდომარემ, პაპუნა ხაჩიძემ  სპეციალური ბრიფინგი გამართა, სადაც ჟურნალისტებსა და საზოგადოებას მხოლოდ  2010 წლის ზაფხულის განმავლობაში ტყეებში მომხდარი ხანძრების სტატისტიკა გააცნო.
საქართველოში ჯამში 430 ჰექტრამდე ტყის მასივი განადგურდა. ბორჯომ-ბაკურიანის სატყეო უბანზე 20 ჰა, აწყურის სატყეო უბანზე 300 ჰა, დაბა სურამში 10 ჰა, რაჭისა და მცხეთა-მთიანეთის რეგიონებში 20-20 ჰა, ხოლო ყვარლის სატყეო უბანზე 50 ჰა ტყის მასივი განადგურდა.
430 ჰექტარი ტყის მასივის განადგურებაში გარემოს დაცვის სამინისტროს მნიშვნელოვანი წვლილი მიუძღვის. ვინაიდან მათ მიერ 2010 წელს არ იქნა გატარებული ხანძარსაწინააღმდეგო პროფილაქტიკური ღონისძიებები.
სატყეო სააგენტოს თავმჯდომარემ პაპუნა ხაჩიძემ დაადასტურა ჩვენთვის გამოგზავნილ წერილში და ფაქტიურად აღიარა, რომ სწორედ მისი უწყებაა დამნაშავე ტყეებში გაჩენილ ხანძრებში. ხანძარსაწინააღმდეგო პროფილაქტიკური ღონისძიებების გატარება გარემოს დაცვის სამინისტროს კანონით ევალებოდა და მის მიერ ამ ღონისძიებების გაუტარებლობით დარღვეულია:
1. საქართველოს გარემოს დაცვისა და ბუნებრივი რესურსების სამინისტროს  სახელმწიფო საქვეუწყებო  დაწესებულება სატყეო დეპარტამენტის დებულების მეორე მუხლის  ბ- ქვეპუნქტი.
2. საქართველოს კანონით საჯარო სამართლის იურიდიული პირის - სატყეო სააგენტოს შესახებ მეექვსე მუხლის ე- ქვეპუნქტი.
3. საქართველოს 2010 წლის სახელმწიფო ბიუჯეტის შესახებ კანონის 55-ე მუხლი.
4. საქართველოს ტყის კოდექსის 10-ე მუხლის დ- ქვეპუნქტი.
თუ 2011 წელსაც საქართველოს ტყეებში იგივე  განმეორდა ”ეკოლოგიური სამართლის ცენტრი” იძულებული იქნება უკვე საქართველოს მთავარ პროკურატურას მიმართოს.  

The inhabitants of Sturua Street demand the removal of Geocell mast

On September 28 leader of Georgia Greens Party George Gachechiladze and the representatives of Ecological Law Centre Nikoloz Mzavanadze and Zurab Jamagidze had a meeting with the population of Nadzaladevi district. As they explained to the inhabitants of Meskhi, Sturua, Khudadov and Kelaptrishvili streets, they would apply any legal measure to solve in the near future the problem, caused by a an installation of a new cellular communication mast.










On September 24 the population of above-mentioned streets appealed to the Centre for help. Two months earlier in Sturua Street N37 on the roof of a dwelling house the company “Geocell” had installed a cellular communication mast. According to the information of the local inhabitants, they recently suffer from frequent headaches, giddiness and various diseases, which they think to be related with electromagnetic emanation.
  The Centre examined the situation on the spot. It turned out that functioning of the mast actually represents a serious problem and greatly endangers the population’s health. Besides, this fact violates various laws and normative legal documents (in particular, reflected in the 37th paragraph of constitution and in the Law “about environmental protection” human right “to live in health-safe environment, to enjoy natural and cultural surroundings; Georgia’s law about “care for public health”, Georgia’s law about “environmental protection”; the 44th order of the Public Health Minister, issued on January 30 1998 “about sanitary-hygienic normative being in force till 1992, to remain temporary valid”; President of Georgia’s order #807 of March 16 1996 about the approval of State program’s schedule of measures of  the years 1999-2005 for promoting health and establishing healthy lifestyle.
  “- We have already sent corresponding letters to the authorities of the Ministry of Environmental Protection and Natural resources and “Geocell”, where we request to dismantle the mast. When we receive an official answer from them we’ll immediately inform you about the advancement of affairs” – announced the representatives of the Centre to the population, which is extremely indignant at disregarding their interests by Geocell.
  “- if they don’t dismantle the mast themselves, then we’ll mount the roof and do it ourselves. We won’t allow our families to be constantly under such risk”, declared a certain part of the population present at the meeting.
  “- If in near future the Ministry and the company don’t take decisive steps, we’re going to lodge a complaint in the Court together with Ecological Law Centre against “Geocell” to claim damages and imposing other sanctions in that connection. By legal means and names we have already achieved desired for people results, for instance in Kaspi, Norio and other places. So, in this case as well we must act in accordance with law”, noted George Gachechiladze and called the population to tranquility and coordinated work.

,,ეკოლოგიურ სამართლის ცენტრს’’ დახმარებისთვის დუშეთის რაიონის სოფელ ახატანის დამსვენებელმა მარინა ბულიამ  მიმართა, რადგან მის მეზობლებად მცხოვრებ პირებს გზის გაყვანის მიზნით გადაწყვეტილი ქონდათ  უნიკალური ჯიშის მუხის და ცაცხვის 100-მდე ძირი ხის მოჭრა.










,,ეკოლოგიური სამართლის ცენტრის’’ წარმომადგენლები და მწვანეთა პარტიის ხელმძღვანელი  გიორგი გაჩეჩილაძე   ადგილზე გაეცნენ  არსებული სიტუაციას.
ტყის მასივის გაჩეხვის შედეგად ეკოსისტემას მართლაც მნიშვნელოვანი ზიანი მიადგება, ამიტომ ცენტრის მიერ გაიგზავნა წერილი გარემოს დაცვის სამინისტროში, რათა სამინისტროს მხრიდან  პრევენციული ზომები ყოფილიყო მიღებული.
პრობლემა გადაიჭრა და სოფელ ახატანში ტყის მასივი გაჩეხვას გადაურჩა.

The guilty have been punished through the effort of Ecological Law Centre

In 2010 On January 3 in the centre of Tbilisi in Kostava Street (Vere garden) during the construction of a dwelling house about 20 sets of completely healthy trees were cut down without permission, which caused great discontent among the inhabitants of the street and the visitors of the park.








Ecological Law Centre examined the situation on the spot. It was by them that employees of the Environmental Protection Inspection had been called, who drew up corresponding reports. As it appeared representatives of a building company LTD “Grato Passage” had no permission for tree-felling. According to the Law only transplanting of the trees is allowed and not their felling. The executives of the Ecological Law Centre appealed to the Ministry of Environmental Protection and Natural Resources requesting to punish the guilty.
  After a certain time the Centre received a letter from the Ministry of Environmental Protection, from which it became clear that Investigation department began examination of the mentioned case. On the fact of illegal tree – felling, employed by the building company, the Superintendant of work Akaki TaTeishvili was made answerable, with whom a procedure agreement was drawn up and he was imposed a fine in the sum of 10 000 GEL. The damage caused to environment was also compensated by Akaki TaTeishvili in the quantity of 3.200 GEL
